SEA OF COMPETENCY TUITION SERVICES TERMS AND CONDITIONS

1. General & Definitions These Terms and Conditions ("Terms") govern the provision of educational services by Sea of Competency ("we", "us", "our"), a sole proprietorship operating in Scotland. By enrolling in our tuition programmes, you ("the Student", "the Customer") agree to be bound by these Terms.

  • "Services" refers to 1-on-1 tuition, oral exam preparation, and digital course materials.

  • "Tutor" refers to the Proprietor or any authorized sub-contractor engaging with the Student.

2. Enrollment and Payment 2.1. Enrollment is subject to availability and confirmation by Sea of Competency. 2.2. Payment: Full payment is required upon booking unless a prior written agreement exists. 2.3. Refunds: All payments for booked sessions are non-refundable. Exceptions are made solely at the discretion of Sea of Competency in cases of proven medical emergency or compassionate grounds.

3. Scheduling, Attendance & Cancellation 3.1. Session Duration: Tuition sessions are scheduled in 1-hour increments. 3.2. Punctuality: The Student is responsible for attending on time. If the Student arrives late, the session will still finish at the scheduled time. No overtime will be provided. 3.3. No-Shows: If the Student fails to join the session within 15 minutes of the start time, it will be classified as a "No-Show." The session will be forfeited, and no refund will be issued. 3.4. Cancellation Policy:

  • Client Cancellation: You must provide at least 24 hours' notice to reschedule a session. Cancellations made with less than 24 hours' notice will result in forfeiture of the session fee.

  • Tutor Cancellation: If we must cancel due to illness or technical failure on our end, we will offer a full refund or a rescheduled slot at your convenience. 3.5. Technical Requirements: The Student is responsible for ensuring they have a stable internet connection. Sessions lost due to the Student's technical failure are non-refundable.

4. Programme Content & Educational Aid 4.1. No Guarantee: Sea of Competency provides expert guidance and mentorship. We do not guarantee a passing grade in MCA exams or the issuance of a CoC. Academic performance remains the sole responsibility of the Student. 4.2. Operational Warning: All content is for exam preparation only. It must not be used for shipboard operational decisions. We accept no liability for real-world machinery failure or incidents resulting from the application of our tuition material.

5. Intellectual Property (IP) 5.1. Ownership: All course materials, including "salient point" answer sheets, diagrams, and oral prep questions, are the exclusive intellectual property of Sea of Competency. 5.2. Prohibited Use: You may strictly use materials for personal study. You are prohibited from:

  • Recording tuition sessions without permission.

  • Uploading our materials to file-sharing sites (e.g., Scribd, CourseHero).

  • Sharing login credentials or materials with other students.

6. Student Conduct & Zero Tolerance 6.1. We operate a Zero Tolerance Policy regarding abuse. 6.2. Sea of Competency reserves the right to immediately terminate services—without refund—if a student engages in aggressive, abusive, or inappropriate behavior towards any Tutor or staff member.

7. Sub-Contractors 7.1. Sea of Competency may engage independent sub-contractors (qualified Marine Engineers) to deliver tuition. 7.2. While we vet our sub-contractors for quality, Sea of Competency acts as the primary service provider and remains your point of contact for all billing and scheduling disputes.

8. Limitation of Liability 8.1. To the maximum extent permitted by law, Sea of Competency shall not be liable for any indirect, incidental, or consequential damages, including loss of career opportunity or exam fees, arising from the use of our Services. 8.2. Our total liability for any claim shall not exceed the specific fee paid by the Student for the disputed tuition session.

9. Governing Law & Jurisdiction 9.1. These Terms shall be governed by and construed in accordance with the Laws of Scotland. 9.2. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish Courts.
